The main form of activities of the Supreme Court, which is the highest judicial organ of the State and court of last resort, to review and adjudicate cases by majority vote, is the Sitting En Banc of the Supreme Court of Mongolia.
The Sitting En Banc develops policies on the administration of justice and provide official interpretation for uniform understanding and application laws /except for the Constitution/.
STTIING EN BANC of the Supreme Court exercises following duties:
- Review and supervise cases resolutions rendered by an supervisory court and of Chief Justice of the Supreme Court ;
- Issue official interpretations or correct application of laws except for the Constitution;
- Negotiate the Rules on Proceedings of the Supreme Court, action’s reports made by Presiding Justices, and to discuss reports, speeches and information made by Chief Judges and judges of Aimag and Capital City Appellate Courts and Soum, Inter-Soum and District Courts on research work of court practice and on implementation of laws and legal acts of Mongolia and official interpretations of the Supreme Court in court practice;
- Develop unified policies for the administration of justice, provide professional guidance of all courts;
- Consider matters concerning protection of human rights and freedoms referred by the Constitutional Tsets ( Court ) and the Prosecutor-General;
- Make nomination of candidates for the position of Chief Justice and recommend candidates for appointments to the Constitutional Tsets (Court) and the National Human Rights Commission;
- Make proposal on granting a title of Mongolian Judiciary “Terguun Tushee-Presiding Tushee” ;
- Review by way of revision cases with decisions of death penalty not depending whether or not was written complain or protest;
- Discuss proposal of a court which states that the Law on Reviewing and Resolving Cases not corresponding to the Constitution and if it has been established to submit the proposal to the Constitutional Court of Mongolia
- Discuss proposal on providing official interpretation for uniform understanding and application of the Election Law submitted by the General Election Committee at the State Parliament
- Establish the Rule on Proceedings of the Supreme Court and to solve other matters as afforded by law
