CHANGES OCCURRED IN STRUCTURE AND
ORGANIZATION OF JUDICIAL SYSTEM

Chief Justice of the Supreme Court became a Chair of  the General Council of Courts based on the conclusion of the National Security Council and recommendation of experts from democracy developed countries and conformity with the revised Law on Courts. This event became vitally important step to separate judicial administration and its organization from politics.

Legal confirmation of independent jurisdiction exercised by first instance, appellate and supervisory courts and court’s decision can be effective soon after its adoption became a guarantee of   independent and impartial court.

Former regulation on writing a protest by justices of the Supreme Court and Chief Judges of Aimag and City Courts against decision of lower courts that influenced the impartiality of court’s   decision was terminated.

The assignment of a case and dispute handed by Chief Judge was changed in a way where Judges’ Meeting sets up a procedure for assigning case at the beginning of each year. The establishment of Judges’ Meeting a self-governing body of all judges of the respective court is aimed to lessen influence of Chief Judge and court official on judges.

Establishment of Chambers for Criminal, Civil and Administrative cases at the Capital City Court is considered to be an important action towards improving case management.

For the purpose of keeping equilibrium of judiciary and executive organizations, Administrative Cases’ Court was established on the 1st of June 2004. The main power of the Administrative Cases’ Court is to exercise court control of activities of the executive organizations within legally defined frame and power.
