THE SUPREME COURT OF MONGOLIA
The Supreme Court of Mongolia shall exercise the following powers:
- Review by way of revision cases and disputes with decisions of the Aimag, Capital City, Soum or Inter-Soum and Districts Courts;
- Hear cases and disputes by way of the first and appellate instance which are referred to its jurisdiction as provided in Article 50, paragraph 1, sub-paragraphs 1 and 2 of the Constitution;
- Consider matters concerning protection of human rights and freedoms referred by the Constitutional Tsets ( Court ) and the Prosecutor-General;
- Exercise original jurisdiction over an application to register newly established political parties in the state registrar;
- Exercise original jurisdiction over and administrative cases, in case of necessity;
- Develop unified policies for the administration of justice, provide professional guidance of all courts;
- Issue official interpretations or correct application of laws except for the Constitution;
- Make nomination of candidates for the position of Chief Justice;
- Recommend a candidate for appointment to the Constitutional Tsets (Court);
- Recommend a candidature for appointment to the National Human Rights Commission;
- Review by way of revision cases with decisions of death penalty not depending whether or not was written complain or protest;
- Establish the Rules of proceedings of the Supreme Court;
- Such other powers as afforded by law.
